Full Online Terms & Conditions

1. This promotion is only open to residents of the United Kingdom aged 25 or over, excluding employees of the Promoter and their immediate families, their agents or anyone professionally associated with this promotion.

2. Promotion Period: Enter between 15:30 on 27th September 2014 and 20:00 on 27th September 2014.

3. To Enter: Log into your Twitter account (or create one for free) and follow @EuropcarFootball, if you are not already doing so. Then, send a tweet about the Arsenal v Tottenham match with the hashtag #FOTM or #AFCLive to be entered into the competition.

All entries will be moderated according to clause 8.

4. No purchase is necessary; however internet access and a valid Twitter account is required.

5. Maximum one entry per person.

6. The Prize: One winner will win 1 x prestige car hire from Europcar. The prize is for weekend hire (Friday – Sunday) to be taken between 4th October 2014 and 21st January 2015 (but excludes 27th and 28th December 2014). Standard terms & conditions of hire apply, see ww.europcar.co.uk or participating Prestige branches for details. Prize available is for Prestige hires in the UK only excluding 4×4 vehicles. Additional products e.g fuel, Risk Reduction Cover+ are not included in the prize. The excess for prestige cars is £2000. The prize is non-transferable. Subject to availability and driver qualification. Minimum age 25, additional age restrictions may apply. Cannot be used in conjunction with any other offer. In order to redeem the vehicle a refundable pre-authorisation deposit of £250 will be required via credit card, driving licence (both parts)and proof of address (Utility bill/bank statement (less than 3 months old).

7. Winner Selection: The winner will be selected within 5 working days after the end of the Promotional Period by a panel of judges containing at least one member who is independent from us (their name is available on request by sending an email to mary@snack-media.com with “Europcar Arsenal Competition Independent Judge” in the subject line to arrive within two months of the end of the Promotional Period. The judges will base their winner selection on adherence to the following criteria:

a. Most insightful comment;
b. Most creative comment; and
c. Most original comment.

8. Moderation: Entries will be rejected and removed if they:

a. contain defamatory, malicious, indecent or other inappropriate content including sexist or racist language or imagery;
b. contain immoral or obscene behaviour;
c. condone or encourage violent or anti-social behaviour;
d. cause offence on the ground of religion, gender, sexual orientation, nudity, disability or age;
e. refer to any brand other than the Promoter;
f. have negative attitudes or thoughts about the Promoter, Arsenal Football Club or any of its related partners;
g. represent a danger, health and safety fear or distress; or
h. Include any reference or image linked to inappropriate or excess drinking.

9. Winner notification: The winner will be notified by direct message on Twitter within 5 working days of the date of judgement. The winner has 14 days to respond to initial notification confirming they wish to claim the prize. If a winner does not respond in the timeframe set out above, the winner will be disqualified and the prize will be awarded to a reserve winner selected in the same manner.

10. Please allow 28 days for arrangement of the prize from prize acceptance.

11. The Promoter accepts no responsibility for late, incomplete, incorrectly submitted, corrupted or misdirected entries, network failure or delay.

12. The Promoter and its associated agencies and companies will not be liable to any prize winner for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize.

13. The prize is not transferable or exchangeable unless otherwise stated and cannot be redeemed for cash or any other form of compensation. In the event for any reason a prize winner does not take any element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize, unless otherwise agreed. If due to unforeseen circumstances the prize is not available, the Promoter reserves the right to substitute another prize for it, in its sole discretion, of equal or higher value.

14. If for any reason any aspect of this promotion is not capable of running as planned, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries (this includes, without limitation, by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion).

15. If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of the prize will be determined by the Promoter.

16. In all aspects of this promotion, the Promoter’s decision is final and no correspondence will be entered into regarding the promotion.

17. This promotion is in no way sponsored, endorsed or administered by, or associated with, Twitter. You understand that you are providing information to the Promoter and not to Twitter. The information you provide will only be used for fulfilment of this promotion unless you have agreed to its use for any other purpose. By entering the promotion all participants agree to a complete liability release for Twitter.

18. The Promoter reserves the right to publish the names and counties of residence of the winners. As a condition of accepting the prize, winners may be required, at the Promoter’s request, to participate in any reasonable promotional activity (such as publicity and photography) surrounding the winning of the prizes, free of charge, and they consent to the Promoter using their names and images in promotional material, including that with third parties.

19. The name and county of the winner may be obtained by sending an email to mary@snack-media.com with “Euopcar Arsenal WL” in the title to arrive between 27th November 2014 and 27th January 2015.

20. Bulk entries made from trade, consumer groups or third parties will not be accepted.  Incomplete or illegible entries, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted.  If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the competition in a way that is not consistent with the spirit of the promotion, that person’s entries will be disqualified and any prize award will be void.

2. Promotion Period: Enter between 16:00 on 27th September 2014 and 12:30pm on 29th September 2014.

7. Winner Selection: All valid entries received during the Promotion Period will be submitted into the prize draw. Winner selection will be conducted within 2 working days of the end of the Promotion Period by PromoVeritas, the independent promotional verification service.

8. Winner notification: The winner will be notified by direct message on Twitter within 5 working days of the date of the draw. The winner has 7 days to respond to initial notification confirming they wish to claim the prize. If a winner does not respond in the timeframe set out above, the winner will be disqualified and the prize will be awarded to a reserve winner selected in the same manner.

9. Further Prize conditions:

a. The winner and their guest may be required to provide proof of age and identity and any documentation as reasonably required to validate their eligibility to claim the prize;
b. Guest must be at least 18 years old; and
c. Any costs or expenses not expressly included in the prize pursuant to these terms and conditions including without limitation, car parking charges, food and drink will be the sole responsibility of the winner and their guest.

Arsenal Home Match Ticket Terms And Conditions Season 2014-2015

1. Issue of Home Match Ticket

1.1 The issue of a Home Match Ticket and subsequent access to the Ground is subject to the Terms and Conditions of Entry (as may be amended from time to time and which can be found on or accessed via the Website or can be provided upon written request to the Club).

1.2 Home Match Tickets are for the use of supporters of the Club only. By applying for the Home Match Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club and/or that you are not a supporter of the Visiting Club.

1.3 The Club licenses you to use Home Match Tickets as selling agent for, and on behalf of, ASMCL. As a result, ASMCL will have all of the rights and obligations of the Club under these Terms and Conditions and your rights and obligations under these Terms and Conditions shall lie against ASMCL only.

1.4 The Home Match Ticket remains the property of the Club at all times. The Home Match Ticket may be cancelled by the Club at any time without providing any reason. A refund will be given to you, in the absolute discretion of the Club and/or in accordance with the Terms and Conditions of Entry, in the event of any such cancellation.

1.5 In the event of any Home Match Ticket issued under these Terms and Conditions becoming lost or stolen, you must inform the Club immediately. In addition, if any Home Match Ticket is stolen, you must also inform the police immediately.

2. Admission to the Ground

2.1 By purchasing and/or accepting and/or holding a Home Match Ticket and/or using a Home Match Ticket to gain access to the Ground, you: (a) certify that you have read, understood and accepted; (b) agree to be bound by and to comply with; and (c) agree to bring to the attention of others, as required below, the Terms & Conditions of Entry.

2.2 The Home Match Ticket shall only entitle the User to gain admission to the Ground after it has been validated by the control readers located at the appropriate turnstiles. The Ground access steward(s) have strict instructions to, and will, refuse admission to any person in the event that
such person’s Home Match Ticket is not so validated by such control readers.

2.3 All persons (including children) must have a valid card or ticket when entering the Ground. The Club will not allow children (or any other person) to be carried through the turnstiles without a
valid card or ticket for the Match.

2.4 A Home Match Ticket permits you to occupy at the Match the seat indicated on the Home Match Ticket or stated on the confirmation receipt/email of purchase in respect of your electronic entry card or such other alternative seat of equivalent value as the Club may, from
time to time, allocate to you at its reasonable discretion. All access to the Ground pursuant to a Home Match Ticket shall be for the purposes of private enjoyment of the Match only, not for any commercial purpose (and no authorisation is given or implied in respect of the carrying out of any commercial activities).

2.5 Nothing in these Terms and Conditions shall constitute or imply any entitlement to occupy the
seat indicated on the Home Match Ticket or ticket confirmation in any subsequent match or season.

2.6 Save as set out in clause 2.7 below, you shall not capture, log, record, transmit, play, issue, show or otherwise communicate (by digital or other means) any Material in relation to the Match, any players or other persons present in the Ground and/or the Ground, nor may you bring into the Ground or use within the Ground (or provide to, facilitate or otherwise assist another person to use within the Ground) any equipment or technology which is capable of capturing, logging, recording, transmitting, playing, issuing, showing or otherwise communicating (by digital or other means) any such Material. Any person acting in breach of this provision may have such equipment or technology confiscated and/or will be required to deliver up any tapes, films, disks, memory cards, memory sticks or other recordings of the Material (and all copies thereof) in whatever form, to the PL and/or the Club and the copyright, database right and all other rights, title and interest in and to all Material is hereby assigned to the PL, including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988. You further agree (if and whenever required to do so by the PL) to
promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to the PL absolutely and with full title guarantee.

2.7 Mobile telephones and other mobile devices are permitted within the Ground PROVIDED THAT
(a) they are used for personal and private use only (which, for the avoidance of doubt and by way of example only, shall not include the capturing, logging, recording, transmitting, playing, issuing, showing, or any other communication of any Material for any commercial purposes);
and (b) no Material that is captured by a mobile telephone or other mobile device may be published or otherwise made available to any third parties including, without limitation, via social networking sites.

2.8 Save for official Club merchandise and/or other football related clothing worn in good faith, you shall not bring into, use, wear or display within the Ground any sponsorship, promotional or marketing materials.

2.9 You shall not offer or distribute (either free or for sale by any person) within the Ground any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe
clause 2.8 above where both the content and the publication are lawful in all respects and do not in the Club’s reasonable opinion constitute a threat to public order.

2.10 The Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply with the Terms and Conditions of Entry.

2.11 Without prejudice to the representation at clause 1.2 above, and in light of the Home Match Ticket holders being grouped together in designated areas, any attempt to gain access to the Ground wearing or carrying apparel (including, without limitation, hats and/or scarves) that demonstrate support for the Visiting Club, may result in admission being refused or you being ejected from the Ground and in such circumstances no refund or alternative seat will be offered.

3. Use of Home Match Ticket

3.1 Subject to clauses 3.3 and 3.4 below, the Home Match Ticket is issued for your sole use and you shall not sell, dispose of, assign, transfer, lend or otherwise deal with the Home Match Ticket or the benefit of it to any other person without the prior written consent of the Club. Further you
shall not use the Home Match Ticket for any commercial purpose. The reference to selling the Home Match Ticket includes: (a) offering to sell a Home Match Ticket (including, without limitation, via any website or online auction site); (b) exposing a Home Match Ticket for sale; (c) making a Home Match Ticket available for sale by another person; and (d) advertising that a Home Match Ticket is available for purchase.

3.2 The Home Match Ticket may not be: (a) offered as a prize in any promotion or competition or transferred, assigned, lent or sold to any third party as part of a hospitality or travel package; (b)given (or offered to be given) to a person who pays or agrees to pay for another good or service;
or (c) used for any other commercial purpose, all save as expressly authorised by the PL or the Club.

3.3 If more than one Home Match Ticket is issued to you, one Home Match Ticket must be retained by you for personal use (subject to the provisions below) and the remainder may be transferred to a Guest(s) for his/her/their personal use only, PROVIDED THAT:
(A) such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket;
(B) such transfer does not take place in the course of any business or for the purpose of facilitating any third party’s business;
(C) such transfer to any Guest(s) will be subject to the Terms and Conditions of Entry which will (save for any rights to transfer under this clause or any rights to a refund under clause 5.2) apply to and bind each Guest as if he/she was the original purchaser of the Home Match Ticket (and you must inform the Guest(s) of this); and
(D) you will provide the name and address of your Guest(s) when asked to do so by any official, steward or employee of the Club and/or any police officer.

3.4 In the event that you and/or your Guest(s) are unable to use any Home Match Ticket then you may transfer that Home Match Ticket(s) to a natural person who is known to you personally and who would be entitled (under the Terms and Conditions of Entry and otherwise) to purchase such Home Match Ticket and attend the Match PROVIDED THAT:
(A) such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket
(B) such transfer does not take place in the course of any business or for the purpose of facilitating any third party’s business;
(C) such transfer will be subject to the Terms and Conditions of Entry which will (save for any rights to transfer under this clause or any rights to a refund under clause 5.2) apply to and bind the transferee as if he/she were the original purchaser of the Home Match Ticket (and you must inform the transferee of this); and
(D) you will provide the name and address of the transferee when asked to do so by any official, steward or employee of the Club and/or any police officer.

3.5 You shall indemnify the Club against all costs, charges, claims, expenses, demands and liabilities suffered or incurred by it as a result of any breach by a User of the Terms and Conditions of Entry.

3.6 The Home Match Ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the Home Match Ticket at any time.

3.7 Any Home Match Ticket obtained or used in breach of the Terms and Conditions of Entry shall be automatically void and all rights conferred or evidenced by such Home Match Ticket shall be nullified. Any person seeking to use a Home Match Ticket in breach of the Terms and Conditions of Entry in order to gain entry to the Ground or remain at the Match may be considered to be a trespasser and may be refused entry to, or ejected from, the Ground in respect of the Match and/or may have his/her Home Match Ticket suspended, cancelled or withdrawn. In the event of any suspension, cancellation or withdrawal in accordance with this clause 3.7 no refund shall be payable. The Club further reserves its right to take any legal or disciplinary action against any person(s) as it sees fit in connection with such matters, including a claim for an account of any profits made from an unauthorised use of a Home Match Ticket.

3.8 Any User, acting alone or with others, whose conduct, or incitement of others, results in disciplinary or legal action against the Club by any Football Authority or any relevant law enforcement authorities, shall be jointly and severally liable with you to the Club for any loss the Club thereby suffers. The User shall also be jointly and severally liable with you to the Club for any loss the Club suffers as a result of the behaviour of a third party gaining access to the Match using the ticket with the User’s permission.

3.9 The unauthorised sale or disposal of a Home Match Ticket may amount to a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006, and such sale or disposal is also illegal under the terms of section 2
of the Fraud Act 2006. The Club will inform the police when it becomes aware that a Home Match Ticket has been sold or disposed of illegally and will press for charges to be brought against those breaking the law. If you are convicted of a ticket touting offence, or we reasonably suspect you to have committed such an offence, we will notify the PL who may in turn notify other PL clubs, any Football Authority and/or the relevant law enforcement authorities. The information that the Club shares may include your personal details, information about the offence and about ticket purchases (including payment details) and, to the extent necessary, you consent to the Club’s use of your data for such purposes. The Club will use this to identify and prevent ticket touting offences and disorder at the Match.

3.10 By entering the Ground, all persons acknowledge that photographic images and/or video recordings and/or stills taken from those video recordings may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the game or by the Club, any other Club Group Company and/or any Football Authority (or their commercial partners) in perpetuity, by way of any present or future media, for any purpose deemed reasonable by the Club, including, without limitation, for marketing, training or promotional purposes. Entry into the Ground is confirmation that all persons have consented to such use of
their image unless the Club is notified in writing to the contrary. If these images should feature an individual prominently the Club will make reasonable efforts to gain the consent of that person before publishing such image. However, if this is not possible, then entry into the Ground shall be deemed consent unless the Club is notified in writing to the contrary.

3.11 Further to clause 3.10 above, if such person is under 18 years of age, either (i) the parent, guardian or responsible adult who is accompanying them into the Ground shall be deemed to have provided consent on their behalf, or (ii) to the extent that such person is not accompanied by a parent, guardian or responsible adult, by that person entering the Ground, that person’s parent or guardian shall be deemed to have provided consent on their behalf.

3.12 If a User is not 16 years old or over, his/her parent(s) and/or guardian(s) are also responsible for his/her actions, conduct and compliance with these Terms and Conditions.

4. Pricing and ticket information whilst the Club tries to ensure that pricing and ticketing information on the Website is correct at all times, errors may occasionally occur. If the Club discovers an error in the price or nature of
the ticket the Club has ordered, the Club will inform you as soon as reasonably practicable, and give you the option of reconfirming your order at the correct price/specification or cancelling it. If the Club is unable to contact you, it will unfortunately have to treat the order as cancelled. If
the order is cancelled, the Club will of course provide you with a full refund (including booking fees).

5. Changes to dates, refunds and exchanges
5.1 No guarantees can be given by the Club that the Match will take place at a particular time or on a particular date. The Club reserves the right to reschedule the Match or, if necessary, play the Match out of view of the public, without notice and without any liability whatsoever.

5.2 In the event of the postponement or abandonment of the Match (or if the Match has, for any reason, to be played out of view of the public), you will be entitled to receive a full refund (including any booking and/or administration fee) on tickets purchased direct from the Club or
its authorised agent or receive the equivalent ticket for the subsequent re-arranged Match (if any) via such application procedure as the Club stipulates, subject to any and all applicable terms and conditions. The Club will have no further, or other, liability whatsoever, including (but not limited to) for any indirect or consequential loss or damage including (but not limited to) loss of enjoyment or travel or accommodation costs.

5.3 Subject to paragraph 5.4 below, in order to obtain a refund on the Home Match Ticket, in accordance with paragraph 5.2 above, a written request must be received by the Club’s box office no later than 72 hours prior to the time of the advertised kick off of the Match. A refund (excluding booking and administration fees and subject to a cancellation fee) will only be issued on production of identification that the individual requesting the refund is the person to whom the Home Match Ticket was originally sold.
For the avoidance of doubt, the final decision belongs to the Club.

5.4 As any Home Match Ticket(s) obtained through the “Ticket Exchange Service” are purchased from the seller (rather than the Club), the Club will not be liable for any refunds of tickets purchased.

5.5 The Club does not guarantee that the team for the Match will necessarily only be selected from the Club’s regular First Team players. The team manager may consider it desirable on occasions to omit regular First Team players and select the team from the full playing squad.

6. Any lost or stolen Home Match Tickets
6.1 In order to gain admission to the Ground, the Home Match Ticket must be presented in its entirety at the Match.

6.2 The Club is not responsible for any Home Match Ticket which is forgotten, lost, stolen, defaced, damaged or destroyed. If the Home Match Ticket is forgotten, lost, stolen, defaced, damaged or destroyed, a duplicate card or ticket may be issued to you, at the Club’s discretion, upon payment by you to the Club of a non-refundable administration fee of £10.00 at the Club’s match day ticket office. The Club reserves the right to require proof of identity and/or withdraw this duplicate ticket facility for the Match without notice.

7. Cancellation and withdrawal of Home Match Ticket
7.1 The Club may remove you or any User from the Ground whom it, acting reasonably: (A) believes to be the subject of a banning or other order prohibiting him/her from entering the Ground or any other stadium;
(B) considers to be using, or have used, any rude, threatening or abusive language or behaviour to, or in respect of, any contractor, employee or agent of the Club, or any other spectator (including, without limitation, any language or behaviour relating to an individual’s or group’s colour, race, nationality, ethnic or national origins, sex, marital status, religion, age or disability); (C) considers to be in breach, be likely to breach, or have breached, any other provision of the Terms and Conditions of Entry; or
(D) believes to be behaving in such a manner as will, or is likely to, cause a hazard to safety or security, or cause any contravention by such person, the Club of (a) any laws or regulations, including the terms of any health and safety, operating or other certificate, licence, consent, permit, approval or other authorisation, applicable to such person or entity or the Ground, or (b) any restrictions imposed by the police or any other relevant authority in relation to the Match from time to time.

7.2 Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of the Terms & Conditions of Entry to (i) cancel and withdraw any Home Match Ticket issued to you, (ii) refuse you or any User entry to and/or eject you or
any User from the Ground in respect of the Match. In the event of such cancellation, refusal or ejection no refund will be paid. Without prejudice to the general nature of the above, the following actions shall constitute serious breach of the Terms & Conditions of Entry:
(A) smoking;
(B) being (or appearing to be) drunk or intoxicated;
(C) persistent standing in seated areas whilst the Match is in progress;
(D) the sale or transfer (save as permitted) of a Home Match Ticket to any person;
(E) the deliberate misuse of a Home Match Ticket;
(F) any misrepresentation in relation to clause 1.2 above;
(G) the possession of a banner or flag that bears material or slogans that are offensive, obscene, abusive or racist;
(H) the throwing of any object within the Ground that may cause injury or damage to people or property without lawful authority or excuse;
(I) the use of foul, obscene, abusive and/or racist language and/or gestures;
(J) the chanting of anything of an indecent or racist nature;
(K) fighting, or engaging in and/or inciting violence;
(L) bringing any of the following into the Ground (or using them within the Ground): illegal drugs; other illegal substances; fireworks; firecrackers; smoke canisters; air horns; flares; laser devices; bottles; glass vessels or any item that might be used as a weapon or compromise public safety;
(M) entering the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse;
(N) the supply of any misleading or incorrect information in any application;
(O) breach of the terms of any Membership Scheme;
(P) any breach of clause 2.6, 2.7 or 2.8 above; and
(Q) any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of any Home Match Ticket.

7.3 The Club may conduct security searches where it has reason to believe that any of the breaches set down in clauses 7.1 and 7.2 have either occurred or may occur.

7.4 The Club will not tolerate racial, homophobic or discriminatory abuse in any form. The Club wants the atmosphere at the Ground to be welcoming to all who attend its games. Any User who is caught abusing a player or any other individual in the Ground will face arrest and prosecution by the police and a lengthy ban from the Club. In addition, the Home Match Ticket will be immediately withdrawn and no refund will be given.

7.5 The Home Match Ticket may be suspended, withdrawn and/or cancelled without the payment of any refund to you, in the event that:
(A) the User is under investigation by the Police, charged, cautioned or found guilty of any football related offence anywhere in the world, is ejected and/or banned from the Ground or any other sports stadium anywhere in the world or breaches any of these Terms and Conditions; or
(B) prior to or whilst the User is using the Home Match Ticket, the User is under investigation by the Police, charged, cautioned or found guilty of any football related offence anywhere in the world, is ejected and/or banned from the Ground or any other sports stadium anywhere in the world or breaches any of these Terms and Conditions.

7.6 Without prejudice to the rights of the Club under this clause 7, the Club shall be entitled to terminate these Terms and Conditions (and cancel any Home Match Tickets) with immediate effect by notice in writing to you in the event that you are at any time, or any other User is, at the time he/she enters the Ground, subject to a banning or other order prohibiting him/her
from entering the Ground or any other stadium.

7.7 The User must immediately surrender the Home Match Ticket upon request by a Club official or a police officer.

7.8 In the event of any cancellation and withdrawal in accordance with this clause 7, no refund shall be payable to you in respect of the Home Match Ticket. The Club further reserves its right to take any legal and/or disciplinary action against any persons as it sees fit in connection with
such matters including a claim for an account of profits made from an unauthorised use of the Home Match Ticket.

7.9 In the event that your Home Match Ticket is withdrawn or cancelled, the Club reserves the right to exclude you from any Membership Scheme and/or to disqualify you from applying for any Match ticket or season ticket at its discretion and to notify any Football Authority and/or other
football clubs of such exclusion and/or disqualification (and the reason(s) for such exclusion and/or disqualification).

8. Undertakings
8.1 You shall, and shall procure that any User shall, at all times:
(A) use the Ground in a proper and lawful manner and not so as to cause any nuisance, annoyance or inconvenience to the Club or any other person (including any other spectators or visitors to the Ground or local residents) or to render void or voidable, in part or whole, any insurance maintained by the Club in respect of the Ground; and
(B) ensure that the Ground is not damaged (fair wear and tear excepted).

8.2 You shall not make, and will procure that no other User makes, without the prior written consent of the Club, any public statement or announcement linking, or implying any relationship between, or engage in any marketing, advertising or promotional activity which links, or implies any relationship between, you and the Club.

9. Security
The Club shall take all reasonable precautions to maintain the security of the Ground between Matches but it shall not be responsible in any way for the loss of, or damage to, any property of you (or any other User) in the Ground (including, without limitation, any property left behind by
you (or any other User) in the Ground). Notwithstanding the foregoing, the Club shall be entitled to dispose of any property left behind by you or any other User in the Ground.

10. Unavailability of seats
10.1 The Club reserves the right, in its sole discretion, to allocate to you an alternative seat anywhere in the Ground, including (but without limiting the circumstances when that discretion may be exercised):
(A) when the stand or part of the stand in which the Ticket seat allocated is located is closed for repairs, maintenance or re-building;
(B) to comply with the requirements of any Football Authority;
(C) when the visiting club is allocated the entire or any part of the stand at the Ground due to be occupied by you; or
(D) when the Club, the police or any other relevant authority or Football Authority otherwise considers it desirable in the interests of safety, crowd control or other Club requirements to re-allocate the seat.

10.2 As far as possible, details of any re-allocation of the seat to which the Ticket applies will be notified on the Website and, where practicable, in advance in the Club’s home Match day programme.

11. Repairs and maintenance
11.1 The Club will be responsible for carrying out all repairs and maintenance (including ordinary
cleaning and rubbish removal) to the Ground provided that the Club will not accept liability for, and shall not be in breach of its obligations by reason of, any breakages or defects to any part of the Ground which are not the result of fair wear and tear or are caused by the acts or omissions
of any User or any other person in possession of a Home Match Ticket. Notwithstanding the foregoing, the Club will not be liable for and will not be in breach of its obligations by reason of any breakages in, or defects to, the Ground if, pursuant to clause 10 or otherwise, it provides
you with an alternative seat (or seats) at the Ground or any other stadium where the First Team plays its home football matches in any competition.

11.2 The Club has the right to charge you for, and you agree to indemnify the Club against, the cost of repairs, maintenance, replacement or cleaning of any part of the Ground to which you (or any other User) have access, or any fixtures or fittings therein, resulting from any act or
omission of you (or any other User) other than as a result of fair wear and tear.

11.3 The Club and each of its employees, agents or contractors shall have the right at any time to
carry out emergency repairs to any part of the Ground to which you (or any other User) has access, or any fixtures or fittings therein, or any adjoining property of the Club, and to suspend access to such areas of the Ground as necessary.

12. Use of concessionary tickets
12.1 Concessionary priced Home Match Tickets may only be used by persons that qualify for such Home Match Tickets, as follows:
(A) “Junior Gunner” Home Match Tickets may only be used by persons who will be aged 4 to 16 at 31 August of the relevant Season;
(B) “Cannon Club” Home Match Tickets may only be used by persons who will be aged 17 or 18 at 31 August of the relevant Season; and
(C) “Senior Citizen” Home Match Tickets may only be used by persons who will be aged 65 or over at 31 August of the relevant Season.

12.2 Any person entering, seeking to enter or having entered the Ground with a concessionary priced Home Match Ticket in circumstances where such person is not entitled to such concession will be refused entry to, or ejected from, the Ground and will have the Home MatchTicket withdrawn.

13. Disabled Members

13.1 This Clause 13 applies to you if you have a Home Match Ticket and are registered with the Club
as a disabled Member.

13.2 You must bring your Home Match Ticket with you to the Match. Your enabler/companion must also bring their relevant Membership Card with them to the Match.

13.3 Enablers/companions must not attend the Match on their own or with any non-disabled person. If you are unable to attend the Match please notify the Disability Liaison Team as soon as possible so that we can sell or donate your place to another disabled supporter, a charity or
local disability organization.
13.4 You must also bring your Disabled Supporters Registration Card (the white photo ID card) with you to the Match.

13.5 Please note that stewards and Club staff will be carrying out checks of tickets. All proven abuses of the disabled supporter’s concessionary scheme will be dealt with severely and will result in the loss of your ticket and/or Membership Card. It may also result in criminal prosecution.

14. Exclusion of liability
14.1 The Club hereby excludes any liability for loss, injury or damage to persons/property in or around the Ground except in respect of death or personal injury resulting from any negligence of the Club or any other liability of the Club which cannot be excluded under applicable law.

14.2 Neither the PL nor the Club shall be responsible for any interruptions and/or restrictions to the view of the Match caused by virtue of (i) the position of the seat and/or (ii) the actions of other spectators.

14.3 Except as otherwise set out in these Terms and Conditions, and to the fullest extent permitted by applicable law, the Club shall not have any liability in respect of any failure to carry out, or any delay in carrying out, any matter in respect of these Terms and Conditions, including
admitting you and/or any other User to the Ground for the Match, caused by any circumstances outside the Club’s reasonable control.

15. General
15.1 The Club reserves the right to make changes to any of these Terms and Conditions. Such changes will be notified to the User by being put on display at the Ground and on the Website.

15.2 Each User consents to the Club holding and processing data relating to them for administrative and legal purposes. The personal data that each User provides to the Club shall be processed, stored and transferred in accordance with the terms of the Club’s privacy policy available on the
Website.

15.3 The invalidity or partial invalidity of any provision of these Terms and Conditions shall not prejudice or affect the remainder of these Terms and Conditions, which shall continue in full force and effect. If any invalid, unenforceable or illegal provision of these Terms and Conditions would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.

15.4 You acknowledge that the Club may fulfil any of its obligations under these Terms and Conditions by procuring such fulfilment from another Club Group Company. Each Club Group Company may benefit from the rights granted to the Club under these Terms and Conditions. Other than the foregoing, and with the exception of each Football Authority, no other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Terms and Conditions. Nothing in these Terms and Conditions shall affect any right or remedy of a third party that exists or is available other than
as a result of the aforementioned Act.

15.5 The Terms and Conditions of Entry constitute the entire agreement between the Club and you in respect of the subject matter and neither the Club nor you shall have any claim or remedy in respect of any statement, representation, warranty or undertaking made by or on behalf of any
other party in relation to the subject matter which is not set out therein.

15.6 The Club’s failure to exercise, or delay in exercising, any right, power or remedy provided by these Terms and Conditions, the documents referenced herein or by law shall not constitute a waiver of that right, power or remedy.

15.7 These Terms and Conditions, and any contractual or non-contractual dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of
England and Wales in relation to any dispute or claim arising out of or in connection with these Terms and Conditions (including in relation to any non contractual disputes or claims).

16. Definitions
In these Terms and Conditions, the following words and phrases shall have the following meanings: “ASMCL” means Arsenal Stadium Management Company Limited. “Club” means The Arsenal Football Club Plc. “Club Group Company” means, in respect of The Arsenal Football Club Plc, its holding companies and subsidiaries of its holding companies, and “holding company” and “subsidiary” have the meanings given to them in section 1159 of the Companies Act 2006 and “Club Group Companies” shall be construed accordingly.“First Team” means the Club’s men’s first
“Football Authority” means the PL, the Football Association, the Football Association of Wales, FIFA, UEFA, the Football League and/or any other relevant governing body of association football, and “Football Authorities” shall be construed accordingly.“Ground” means Emirates Stadium, London N7 7AJ.“Ground Regulations” means those ground regulations issued by the Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground (copies of which are on display at the Ground and on the Website). “Guest” means a relative, friend, colleague and/or, companion to disabled supporters who would be entitled to purchase a Home Match Ticket under the Terms and Conditions of Entry.“Home Match Ticket” means the electronic entry card, print at home ticket, printed paper ticket or any other method for entry stipulated by the Club from time to time (and/or any rights arising out of or in connection with the foregoing) for admission to a Match.“Junior Gunner” means a Member between the ages of 4 and 16. “Match” means the match at the Ground played by the First Team to which these Terms and Conditions apply.“Material” means any audio, visual or audio-visual material or any information or data.“Member” means a member of a Membership Scheme.
“Membership Card” means a card issued by the Club to indicate membership of a Membership Scheme. “Membership Scheme” means each of the membership schemes of the Club available to fans, the terms and conditions of which are available on the Website. “PL” means the Football Association Premier League.“Terms and Conditions” means these terms and conditions governing the issue and use of a Home Match Ticket.
“Terms and Conditions of Entry” means each of the rules and regulations of each Football Authority, the Ground Regulations and these Terms and Conditions, each as may be amended from time to time at the sole discretion of the Club. Any amendments to the Terms and
Conditions of Entry will be notified to you either through the respective organisation’s website, or by being put on display at the Ground and through the Website. “UEFA Competition” means the UEFA Champions League or the UEFA Europa League. “User” means: (i) you; or (ii) any person who uses the Season Ticket in accordance with clause
3.3 or 3.4.14 “Visiting Club” means the football club playing against the Club in respect of the Match. “Website” means the Club’s website, currently www.arsenal.com.

Arsenal Ground Regulations

Entry to the Ground is expressly subject to acceptance by the visitor of these Ground Regulations and the Rules and Regulations appropriate to the relevant competition. The Club Charter (as may be published from time to time on the Club’s website) is hereby incorporated in, and forms part of, the Ground Regulations. Entry to the Ground shall constitute acceptance of the Ground Regulations. “Club” means The Arsenal Football Club plc.
“Football Authority” means The Premier League, Football Association, the Football Association of Wales, FIFA, UEFA and/or any other relevant governing body of association football. “Ground” means Emirates Stadium, London, N7 7AJ (the “Stadium”) and all locations owned, occupied or utilized by the Club. “Match” means any football match, or other event open to the public, taking place at the Ground. “Material” means any audio, visual or audio-visual material or any information or data. “Rules and Regulations” means the rules and regulations of FIFA, UEFA, The Football Association, the Premier League and The Football League. “Stadium Company(ies)” means Arsenal (Emirates Stadium) Limited together with its successors in title to the Stadium and any operator or manager of the Stadium.

1. Permission to enter or to remain within the Ground (notwithstanding possession of any ticket) is at the absolute discretion of the Club, each Stadium Company, any police officer or authorized steward. On no account will admission be granted to a person who is the subject of a current Banning Order under the Football Spectators Act 1989 (as amended) or has been convicted of ticket touting offences under the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006.

2. The Club and each Stadium Company excludes to the maximum extent permitted by law any liability for loss, injury or damage to persons and property in or around the Ground.

3. No guarantees can be given by the Club that a Match will take place at a particular time or on a particular date, or at all, and the Club reserves the right to reschedule or cancel a Match without notice and without any liability whatsoever, save as set out in Condition 4, below.

4. In the event of the postponement or abandonment of the Match, or if the Match has, for any reason, to be played out of view of the public, refunds (if any) will be made in accordance with the specific ticket terms and conditions applicable to your ticket purchase. The Club and Stadium Companies will have no further liability whatsoever, including (but not limited to) liability for any indirect or consequential loss or damage, such as (but not limited to) loss of enjoyment or travel costs.

5. All persons seeking entrance to the Ground acknowledge and agree to the Club’s and each Stadium Company’s right to search any person entering the Ground and to refuse entry to or eject from the Ground any person refusing to submit to such a search.

6. The following articles must not be brought within the Ground – knives, fireworks, smoke canisters, air-horns, flares, weapons, dangerous or hazardous items, laser devices, glass bottles, glass vessels, cans, pole and any article that might be used as a weapon and/or compromise
public safety. Any person in possession of such items will be refused entry to or ejected from the Ground.

7. The use of threatening behavior and/or foul or abusive language is strictly forbidden and will result in arrest and/or ejection from the Ground. The Club may impose a ban (including, but not limited to, a ban for one or more Matches) and/or the removal of season ticket(s) and/or Club membership for any such behaviour.

7.1 Racial, homophobic or discriminatory abuse, chanting or harassment is strictly forbidden and will result in arrest and/or ejection from the Ground. The Club may impose a ban (including, but not limited to, a ban for one or more Matches) and/or the removal of season ticket(s) and/or Club membership for any such behaviour.

7.2 The following acts are arrestable offences under the Football (Offences) Act 1991, as amended: (A) the throwing of any object within the Ground without lawful authority or excuse; (B) the chanting of anything of an indecent or racialist nature; and (C) the entry onto the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse. Conviction may result in a Banning Order being made.

8. All persons entering the Ground must be in possession of a valid ticket for that particular Match (which may take the form of a membership car or season ticket validated for the Match in question) and have it available for inspection at all times. They may only occupy the seat allocated to them by that ticket and must not move from any one part of the Ground to another without the express permission of the duty safety officer at the Ground. Proof of age, where an age concession is claimed, and proof of identity may be required and must be supplied on demand.

9. Nobody may stand in any seating area whilst play is in progress. Persistent standing in seated areas whilst play is in progress is strictly forbidden and may result in ejection from the Ground and possible further action by the Club or a Stadium Company.

10. The obstruction of gangways, access ways, exits and entrances stairways and like places is strictly forbidden. Nobody entering the Ground shall be permitted to climb any structures within the Ground.

11. The Ground is a no smoking environment. Smoking (including the use of electronic cigarettes) is not permitted in any part of the Ground and will result in ejection from the Ground.

12. Mobile telephones and cameras are permitted within the Ground, provided that they are used for personal and private use only provided that no Material captured by a mobile telephone or camera may be published or otherwise made available to any third parties including, without limitation, via social networking sites. Notwithstanding the foregoing, neither mobile telephones nor cameras may be used to record any Material in relation to the Match. Any person found to be in breach of this Condition may b ejected from the Ground and the Club may impose a ban (including, but not limited to, a ban for one or more Matches) for any such behaviour.

13. To comply with the Sporting Events (Control of Alcohol etc) Act 1985 (as amended) admission to the Ground will be denied to persons:

13.1 attempting to enter the Ground or being inside the Ground whilst drunk; or
13.2 in possession of any intoxicating liquor, controlled, or illegal substances or any article (or part of an article), such as a bottle, can or other portable container which is for holding any drink, which could cause damage or personal injury, when entering or trying to enter the Ground or in a public area of the Ground from which the event can be directly viewed.
The offences set out in Conditions 13.1 and 13.2 are arrestable offences and conviction could result in a Banning Order being made under the Football Spectators Act 1989 (as amended). The list above is non-exhaustive.

14. Any individual who has entered any part of the Ground designated for the use of any group of supporters to which he does not belong may be ejected from the Ground either for the purposes of his own safety or for any other reason.

15. Save as set out in Condition 12 above, no person (other than a person who the Club determines, in its discretion, holds an appropriate licence) may capture, log, record, transmit, play, issue, show or otherwise communicate (by digital or other means) any Material in relation to the Match, any players or other persons present in the Ground and/or the Ground, nor may they bring into the Ground or use within the Ground (or provide to, facilitate or otherwise assist another person to use within the Ground) any equipment or technology which is capable of recording, capturing, logging, playing, issuing, showing, transmitting or otherwise communicating (by digital or other means) any such Material or any information or data in relation to the Match, any players or other persons present in the Ground and/or the Ground. Copyright, database rights and any other intellectual property rights in any unauthorised recording or transmission is assigned (by way of present assignment of future copyrightpursuant to section 91 of the Copyright, Designs and Patents Act 1988) to the Club and the Premier League. Without prejudice to Condition 24 below, a person failing to comply with this regulation may have such equipment confiscated and/or may be liable to deliver up to the Club any such tapes, films, disks or other recordings or data. You further agree (if and whenever required to do so by the Club and/or the Premier League) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such right to the Club and the Premier League absolutely and with full title guarantee.

16. No goods (including literature) or services of any nature may be offered either free or for sale by and person within the Ground without the express written permission of the Club. Unauthorised goods will be confiscated by the Club. Save for official Club merchandise and/or other football related clothing worn in good faith, visitors shall not bring into, use or display within the Ground any sponsorship, promotional or marketing materials.

17. Tickets are not transferable and may not be offered for sale without the prior written permission of the Club or otherwise as set out in the express terms and conditions of such tickets. Any tickets that are transferred are transferred subject to the Ground Regulations. Any tickets offered for sale in breach of the terms and conditions thereof may be confiscated by any steward or officer of the Club or any police officer. The Club reserves the right to refuse admission to or eject from the Ground, any person who has transferred his/her ticket in contravention of the relevant ticket terms and conditions (and/or the holder of any ticket that has been transferred in contravention of the relevant ticket terms and conditions). In the event of any refusal of admission or ejection from the Ground no refund shall be payable. Tickets remain the property of the Club at all times.

18. By entering the Ground, all persons acknowledge that photographic images and/or video recordings and/or stills taken from those video recordings may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the game or by the Club and/or any Football Authority (or their commercial partners) in perpetuity, by way of any present or future media, for any purpose deemed reasonable by the Club, including, without limitation, for marketing or promotional purposes. Entry into the Ground is confirmation that all persons have consented to such use of their image unless the Club is notified in writing to the contrary. If these images should feature an individual prominently the Club will make reasonable efforts to gain the consent of that person before publishing such image. However, if this is not possible, then entry into the Ground shall be deemed consent unless the Club is notified in writing to the contrary.

19. Further to Condition 18, if such person is under 18 years of age, either (i) the parent, guardian or responsible adult who is accompanying them into the Ground shall be deemed to have provided consent on their behalf, or (ii) to the extent that such person is not accompanied by a parent, guardian or responsible adult, by that person entering the Ground, that person’s parent or guardian shall be deemed to have provided consent on their behalf.

20. CCTV cameras are in use in and around the Ground and the Club or a Stadium Company may itself use or pass to a Stadium Company or the Club (as the case may be), the police or any football regulatory or professional body, any recordings for use in any proceedings.

21. At all times whilst present in the Ground, persons must comply with any and all instructions and directions of any steward or officer of the Club or any Stadium Company, any police officer or any officer of any other safety service. Failure to comply with any such instruction or direction may lead to the refusal of entry to, or the immediate ejection from, the Ground.

22. Any person found damaging or defacing the property of the Club or any Stadium Company will be prosecuted.

23. No re-entry to the Ground is permitted unless permission is given by an officer or a steward of the Club.

24. The Club and each Stadium Company reserves absolutely the right to refuse entry and eject from the Ground any person that fails (or in the Club’s reasonable opinion is likely to fail) to comply with any of the Ground Regulations or whose presence within the Ground is, or could (in the Club’s reasonable opinion), be construed as constituting a source of danger, nuisance or annoyance to any other person. This could lead to further action by the Club including, but not limited to, the withdrawal of any Club membership and or match ticket and/or season ticket (without reimbursement) and other benefits.

25. The Club reserves the right to make changes to any of the regulations set out in this document in its sole discretion. Any such changes will be notified to the public through the Club’s website (www.arsenal.com) and on display at the Ground.
